INTRODUCTION

Range Arts (together with its affiliates and subsidiaries, "we," "us," "our") provides this Website (this site and any software provided by the Company for use with the site, the "Site") subject to these terms of use ("Terms"). Users ("Users") of the Site include both registered and unregistered users.

Please read these Terms carefully. By accessing, using, or browsing the Site, you agree to be legally bound by these Terms and all related policies and guidelines. If you do not agree with these Terms, you may not use the Site and may choose to exit the Website. All services provided through this Site are designed to meet the guidelines and standards set by the Firearms Safety Education Service of Ontario (FSESO). Users must adhere to these standards as a condition of participation in any training or licensing programs.

The Company reserves the right to change or modify any of the terms and conditions contained in these Terms, or any policy or guideline of the Site, at any time and in its sole discretion. If we do so, we will notify you at the email address you provide in your registration information, if any. If you do not agree with the changes, you can cancel your account with us without further obligations.

SERVICES

Range Arts provides a comprehensive range of educational and licensing support services, specifically designed to promote firearm safety and compliance with the Firearms Safety Education Service of Ontario (FSESO) guidelines. Our services ensure that users receive the training and resources necessary to meet or exceed the required standards for safe firearm use.

The educational training offered by Range Arts includes both theoretical and practical components of firearm safety. These training sessions cover essential topics such as the safe handling, storage, transportation, and maintenance of firearms. Each course is structured to provide participants with the knowledge and skills needed to ensure responsible firearm ownership and usage.

In addition to training, Range Arts offers licensing support services to assist users in navigating the regulatory requirements for firearm certification. This includes step-by-step guidance on completing licensing applications and other applicable legal standards. We also provide resources and preparation materials to help participants successfully complete safety certification exams.

By utilizing our services, users agree to comply with all legal and safety regulations as outlined by the FSESO. The services provided through the Site are intended for personal use only and cannot be resold, leased, or transferred to others. Range Arts remains committed to safeguarding user data and adhering to applicable data protection laws, as detailed in our Privacy Policy.

Our aim is to empower users with the tools and knowledge necessary to uphold the highest standards of firearm safety while ensuring compliance with all relevant guidelines and laws.

USER OBLIGATIONS

If you register for an account on the Site, you agree to:
(a) provide accurate, current, and complete information as may be prompted by any registration forms on the Site ("Registration Data");
(b) maintain the security of your password;
(c) maintain and promptly update the Registration Data, and any other information you provide to the Site, to keep it accurate, current, and complete; and
(d) accept all risks of unauthorized access to the Registration Data and any other information you provide to the Site. You are responsible for all activity on your Site account.

By accessing this Site or using our services, you confirm that you:
-           Are at least 18 years of age or meet the minimum age requirement under Ontario law for firearm safety certification.
-           Possess the necessary permits or qualifications required for firearm safety training and licensing under FSESO guidelines.
-           Are not prohibited by law from engaging in firearm-related activities.

COMPLIANCE AND USER RESPONSIBILITY

Adherence to Guidelines and Laws:

By accessing the Site or utilizing the services provided by Range Arts, you agree to comply fully with all applicable laws, regulations, and guidelines, including but not limited to those established by the Firearms Safety Education Service of Ontario (FSESO) and other regulatory bodies.

Prohibited Conduct:

You shall not:

  • Use the services or certifications for any illegal or unauthorized purposes.

  • Falsify or misrepresent any information provided during training, certification, or licensing processes.

  • Engage in unsafe, reckless, or otherwise non-compliant behavior during training sessions or in firearm handling practices.

Responsibility for Legal Compliance:

You are solely responsible for ensuring that your participation in any training or licensing program, as well as your use of any certifications obtained, aligns with applicable local, provincial, and federal laws, including those concerning firearm ownership, storage, handling, and transportation.

Termination for Non-Compliance:

Range Arts reserves the right to terminate your account, deny certification, or restrict access to services if you are found to have violated any laws, FSESO standards, or these Terms, or if your behavior poses a safety risk to others.

Reporting Obligations:

You agree to report any incidents, injuries, or safety concerns arising during training sessions to Range Arts immediately. Failure to report such incidents may result in disciplinary action or termination of services.

CONTENT AND INTELLECTUAL PROPERTY RIGHTS

The use of this Site is currently free of charge, and no fees are imposed for accessing its features or content. In these Terms, "Content" refers to all materials available on the Site, including but not limited to information, data, logos, trademarks, designs, graphics, images, photographs, audio files, video files, and other media, as well as their arrangement, selection, and presentation. Content provided by users of the Site is referred to as "User Content." User Content remains the sole property of the respective User who provides it. The Company’s rights to User Content are strictly limited to the licenses explicitly granted by the User in these Terms.

All other Content on the Site, including but not limited to the Site’s design, structure, layout, and functionality, as well as the software and technology used to operate it, is the exclusive property of the Company or its licensors. This Content is protected by Canadian and international copyright laws, trademarks, patents, and other intellectual property laws. All rights to this Content and software are expressly reserved by the Company or its licensors.

By using the Site, Users agree not to:

1.   Copy, reproduce, distribute, republish, download, display, post, transmit, or create derivative works from any Content on the Site without the prior written permission of the Company or the respective copyright owner.

2.   Modify, reverse engineer, decompile, or disassemble any software or code associated with the Site.

3.   Use any trademarks, logos, or proprietary marks displayed on the Site without the Company’s explicit written consent or that of the respective trademark owner.

Licensing of User Content - By uploading, submitting, or otherwise making available User Content on the Site, Users grant the Company a limited, non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content, solely for the purpose of operating, promoting, and improving the Site and its services. This license is revocable by the User at any time, subject to the Company’s ability to retain backups or comply with legal obligations.

Third-Party Content - The Site may also feature content that is owned or licensed by third parties. Such content is provided for informational purposes only and remains the property of its respective owners. Users are prohibited from using any third-party content without obtaining the necessary permissions from the content owner or as otherwise permitted by law.

SCHEDULING

1.     Appointment Scheduling:

Clients are required to schedule their firearms licensing training or consultation appointments through the online booking system or by contacting the business directly. Appointments are subject to availability and will be confirmed upon receipt of payment where applicable.

2.     Rescheduling Requests:

Clients may request to reschedule their appointment by providing a minimum of 48 hours notice. Requests can be made via emailor through the online booking platform. Rescheduling is subject to the availability of alternative slots.

3.     Late Rescheduling or Cancellations:

Failure to provide the required notice for rescheduling or cancellations will result in the forfeiture of the 50% deposit paid. Additionally, the remaining 50% of the course fee will be charged, unless the client demonstrates exceptional circumstances, as determined at the business's sole discretion.

4.     Missed Appointments:

If a client fails to attend their scheduled appointment without prior notice, the appointment will be deemed forfeited. The 50% deposit will be forfeited, and the remaining 50% of the course fee will be charged. No refunds or credits will be issued. Clients will need to rebook and pay any applicable fees for a new appointment.

5.     Business-Initiated Changes:

The business reserves the right to reschedule or cancel appointments due to unforeseen circumstances, including but not limited to instructor unavailability, weather conditions, or other operational issues. In such cases, clients will be notified as soon as possible and offered an alternative appointment or a full refund.

6.     Timeliness:

Clients are expected to arrive on time for their scheduled appointments. Late arrivals of more than 15 minutes may result rescheduling, with applicable fees.

7.     Acknowledgment:

By scheduling an appointment, the client acknowledges and agrees to the terms of this Scheduling and Rescheduling Policy.

PAYMENT POLICY

Full payment is required at the time of booking to confirm a client’s spot in the firearms licensing training or consultation. Appointments will not be scheduled or held without the receipt of full payment. The business accepts payment through authorized methods, which may include credit card, e-transfer, or other specified payment channels. Clients are responsible for ensuring that payment is completed successfully at the time of booking.

All payments are non-refundable, except in situations where the business cancels the appointment or training session. Refunds for cancellations initiated by the client will only be considered at the sole discretion of the business and may be subject to an administrative fee. If a client requests to reschedule an appointment in accordance with the Scheduling and Rescheduling Policy, any payments made will be applied as a credit toward the rescheduled session. Rescheduling is subject to availability, and additional fees may apply if relevant.

REFUND POLICY

Refunds for services are provided solely at the discretion of Range Arts and are subject to the following conditions:
- Refunds are not available once a training course or certification process has commenced.

-The 50% deposit is forfeited if a client cancels after booking.
- Cancellations must be requested at least 48 hours before the scheduled start date of any training course.
- Any administrative fees associated with cancellations will be deducted from the refund.

RIGHT TO REFUSE OR CANCEL TRAINING

The organization reserves the right to refuse or cancel any training session if, in its sole discretion, it determines that the candidate is unfit to participate. This determination may be based on a variety of factors, including but not limited to, concerns about the candidate’s physical or mental readiness, failure to meet the required eligibility criteria, or behavior that poses a risk to the safety of others, the candidate, or the integrity of the training session. Additional reasons for determining unfitness may include actions or conduct that disrupts the training environment, violates the organization’s policies, or is otherwise inconsistent with the objectives or requirements of the program.

In the event that the organization decides to refuse or cancel a candidate’s training, the candidate will be informed promptly, and the reasons for the decision will be clearly communicated. The organization’s decision in such matters is final and made in good faith to ensure the safety and effectiveness of the training program.

Refunds or credits for canceled training sessions under this clause will be considered at the sole discretion of the organization. The organization will review the specific circumstances of each case, including whether the candidate’s actions or conditions leading to the cancellation were avoidable or foreseeable. Where appropriate, administrative fees may be deducted from any refunded amounts or applied to future training sessions.

CLASSROOM BEHAVIOUR POLICY

Participants are expected to always conduct themselves in a respectful and professional manner during the training session. Any behavior that disrupts the learning environment, interferes with the training process, or compromises the safety or comfort of others will not be tolerated. Examples of disruptive behavior include, but are not limited to, excessive talking, use of offensive language, refusal to follow instructions, or any actions deemed inappropriate by the instructor.

The instructor reserves the right to issue warnings or, if necessary, remove a participant from the classroom if their behavior is disruptive or detrimental to the training environment. In cases where a participant is removed from the class, no refunds or credits will be provided, and the participant may be barred from attending future sessions at the discretion of the organization.

For the safety, security, and quality assurance of the training, all classroom sessions are recorded. By attending the training, participants consent to being recorded during the session. These recordings may be used by the organization for internal purposes, including reviewing incidents of disruptive behavior, improving training quality, or addressing safety concerns.

By enrolling in the training, participants acknowledge and agree to abide by this Classroom Behavior Policy to ensure a safe and productive learning experience for all attendees.

INDEMNIFICATION AND DISCLAIMER

You shall defend, indemnify, and hold harmless the Company and the other Released Parties from any loss, damages, liabilities, costs, expenses, claims, and proceedings arising out of your use of the Site and from the use of the Site by any person to whom you give access to your account, including any claims made by any person that any of your User Content infringes the rights, including the intellectual property rights, of any third party.

LIMITATION OF LIABILITY
Range Arts assumes no liability for any injury, damages, or legal consequences arising from the improper use of information, training, or certifications provided through this Site. Users are responsible for ensuring they comply with all applicable safety guidelines and laws.

Maximum Liability

To the fullest extent permitted by law, the total liability of Range Arts, its affiliates, officers, directors, employees, agents, or licensors (collectively, "Released Parties") for any claim, damage, loss, or cause of action arising from or related to your use of the Site or our services, whether in contract, tort, or otherwise, shall not exceed the amount paid by you to Range Arts for the specific service or course from which the liability arose.

Exclusion of Indirect and Consequential Damages:

The Released Parties shall not, under any circumstances, be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of profits, revenue, goodwill, data, or other intangible losses, even if advised of the possibility of such damages.

Assumption of Risk:

You acknowledge and agree that the services provided, including but not limited to firearm safety training and licensing support, inherently involve risks. You assume all responsibility and liability for any personal injury, property damage, or other harm resulting from your participation in these services or use of information provided by the Site.

No Liability for Third-Party Acts or Omissions:

The Released Parties shall not be held liable for any acts, omissions, or negligence of third parties, including but not limited to other participants, instructors, or any third-party providers involved in delivering services.

No Warranty or Guarantee:

The Released Parties do not warrant or guarantee that participation in training or use of the services will result in successful certification, compliance with FSESO guidelines, or legal authorization to engage in firearm-related activities. Your reliance on the services is at your own risk.

Jurisdictional Limitation:

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such cases, the liability of the Released Parties shall be limited to the maximum extent permitted by applicable law.

GOVERNING LAW AND DISPUTES

The Site is controlled by the Company and operated by it from its offices in Ontario, Canada. You and the Company explicitly agree that all disputes, claims, or other matters arising from or relating to your use of the Site will be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

Any disputes arising from the use of this Site or services will be resolved under the jurisdiction of the laws of Ontario, Canada, in accordance with FSESO regulations.
