Booking Terms & Conditions and Activity Waiver & Release

Our mission is to provide the most welcoming, fun, and comprehensive courses available – but before we get to the fun part we have to review information about your purchase. Please bear in mind our policies are designed to be flexible and convenient for you while minimizing empty seats due to last-minute rescheduling, cancellation, or no-shows, which have a negative impact on the class environment and our business and which are not within our control:

This Terms & Conditions and Liability Waiver & Release (this “Agreement”) dated the date you completed your booking and/or indicated to Range Arts this Agreement was read and agreed to between the person(s) making the booking and/or attending the event (“You”) of the “Home Address” submitted to Range Arts upon completing the booking and Range Arts Training Canada Ltd. (“Range Arts”) of Suite 160, 50 Ronson Drive, Etobicoke, ON, M9W 1B3

IN CONSIDERATION OF the covenants and agreements contained in this Agreement and other good and valuable consideration, the receipt of which is hereby acknowledged, the parties to this Agreement agree as follows:

  1. BOOKING: Completing a booking at rangearts.ca or by email with Range Arts results in a hold being placed on a seat for you at an event to be held by Range Arts at the particular date, time, and place you selected.

  2. BOOKING CONFIRMATION AND PROCESSING: Your booking is confirmed when Range Arts sends you a confirmation in the form of a confirmation page or email (“Booking Confirmation”). If you do not receive a Booking Confirmation after booking, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm with Range Arts by email (https://rangearts.ca/contact) whether or not your booking has been placed. Only you may be aware of any problems that may occur during the booking process. We will not be responsible for losses (monetary or otherwise) if you assume that a booking was placed or not placed because you failed to receive confirmation from us. An electronic payment receipt is also not a Booking Confirmation and is not to be interpreted as such.

  3. HOLD ON SEAT: The seat you booked for a particular date, time, and place will be held for you by Range Arts unless otherwise instructed (by rescheduling or cancelling). Each event has a limited capacity due to Federal and/or Provincial regulations and/or Range Arts policies (meaning each seat is valuable to Range Arts) and it is your responsibility to ensure you make use of the seat you have booked. If you opt not to use your seat it will not be grounds for credit, refund, or forgiveness of any amount owing.

  4. AMOUNT OWING: If Range Arts does not charge you the full purchase price for your seat plus relevant taxes (as described on rangearts.ca as the course fee, the price, the cost) upon completing your booking the balance remaining is thereafter immediately an amount owing to Range Arts.

  5. SETTLING THE AMOUNT OWING: Range Arts reserves the right to settle the amount owing anytime by charging the credit card you validated at the time of booking, however standard practice is to settle the amount owing at the start of the event (so that you may choose alternate payment method in person). At the time of settling the amount owing any deposits you may have paid, credits you may have with Range Arts, or discounts you may be eligible for will be applied to the amount owing.

  6. FULL PAYMENT REQUIRED FOR QUALIFICATION: In the rare event you are allowed to attend the event without having paid in full your course qualifications will not be processed until the amount owing is settled.

  7. NOT PRESENT AT THE EVENT (NO-SHOWS): If you are not present at the date and time of the event (also called “No-Shows”) Range Arts settles your amount owing for the event. Not being present to use the seat you have booked is not grounds for a refund or credit.

  8. ACCEPTABLE FORMS OF PAYMENT: Range Arts accepts most major credit cards online. In person Range Arts accepts most major credit cards and debit cards but does not accept or handle cash.

  9. NON-REFUNDABLE DEPOSITS: Certain bookings require payment of non-refundable deposits at the time of booking, which are applied to the amount owing for the related booking when the amount owing is settled, and are non-refundable. Non-refundable means they are forfeit and lost if the booking is cancelled or if the booking is rescheduled outside of the “Allowable Rescheduling Period”.

  10. ALLOWABLE RESCHEDULING PERIOD: A booking can be rescheduled up to 5 calendar days before the date and time of the booking without any impact to deposits or credits by following the links at the bottom of your booking confirmation email or by contacting Range Arts, however discounts may not apply after rescheduling.

  11. CANCELLING A BOOKING: A booking can be cancelled by using the link at the bottom of your confirmation email up to 5 days before the date and time of your booking or by notifying Range Arts by email up to 48 hours prior to the date and time of your booking. Upon receiving notification from you of the cancellation Range Arts will release the hold on your seat and forgive the amount owing less any deposits you have paid (non-refundable deposits already paid are lost and forfeit upon cancellation).

  12. ADMINISTRATIVE FEES: In the rare circumstance Range Arts elects to refund a non-refundable deposit there will be an administrative fee of $15 per refund.

  13. REMINDERS: Range Arts will send booking confirmation and booking reminder communications by email to the email address you provided at the time of booking but bears no responsibility if you do not receive or read these reminders.

  14. LEAVING EARLY: Opting to leave the event early will not be grounds for a refund or credit.

  15. COURSE COMPLETION MINIMUM HOURS: Some events (courses) require you to complete a minimum number of hours of instruction in order to be issued your qualifications from third party organizations. If you fail to complete these hours due to lateness, frequent interruptions, failing to pay attention, or any other reason outside the control of Range Arts, it will not be grounds for a refund or credit.

  16. COURSE ELIGIBILITY: It is important that you verify you are eligible to attend the event you have booked. Range Arts explains eligibility throughout rangearts.ca and during the booking process. You should verify eligibility by contacting Range Arts if you are unsure. If you arrive at an event you are not eligible for your instructor must dismiss you and it will not be grounds for refund or credit.

  17. COURSE COMPLETION TESTING: Some events (courses) require successfully passing written and/or practical examinations administered by your instructor in order for third party organizations to issue your qualification. In the event you are not successful your instructor will recommend options for re-taking the course and/or re-taking examinations. These recommendations are at the sole discretion of your instructor and there may be fees for these activities which are assessed on a case-by-case basis and which Range Arts generally keeps as minimal as possible. Range Arts prefers you to pass the course on your first attempt, however cannot guarantee this outcome or assume the cost of any re-training or re-testing you might require in order to be successful, and will not be grounds for a refund or credit.

  18. THIRD PARTY QUALIFICATION PROCESSING: Range Arts is required to transmit (electronically or by mail) the results of some events (courses) to third party organizations which process results and issue qualifications which are transmitted (electronically or by mail) back to you. Range Arts is not responsible for delays, omissions, or negative outcomes caused by errors in transmission or the independent actions of these organizations and is not responsible for losses (monetary or otherwise) caused by these organizations, and will not be grounds for a refund or credit.

  19. NO GUARANTEE OF LICENCE: Third party independent organizations assess licence applications. Range Arts cannot make a licence application on your behalf and cannot guarantee you will be issued a licence by these organizations. Completing an event (courses) does not guarantee you will receive a licence and the outcome of a licence application will not be grounds for a refund or credit.

  20. RULES: There are easy-to-follow rules set by Range Arts, third party organizations, and your instructor, which apply throughout the event (course). Failure to follow these rules may result in failure or being dismissed from the course which will not be grounds for refund or credit. In general, however rare, the instructor can dismiss any participant from the course at their sole discretion without refund or credit.

  21. REFUNDS: In the event Range Arts opts to refund or credit a payment you have made, it will endeavour to process the refund within 3 business days, however please note refunds can take around 10 more days to show on your bank statement depending on your bank.

  22. SCHEDULE CHANGES: From time to time Range Arts may need to make changes to the event schedule or it may be impacted by events outside the control of Range Arts including ‘force majeure’. If your booking is affected we will attempt to contact you by email to reschedule (administration fees will not apply to changes we make) and Range Arts We will not be responsible for losses (monetary or otherwise) caused by this change.

  23. ELECTRONIC COMMUNICATION: You agree to receive communication from Range Arts by phone, text message, and/or email regarding your booking, for your convenience, and to be notified of new products and features. You may opt out of these communications at any time. Review our website Terms of Use and Privacy Policy for more information.

  24. Being of lawful age and in consideration of being permitted to participate in the activity described below, you release and forever discharge Range Arts, its owners, directors, officers, employees, agents, assigns, legal representative and successors from all manner of actions, causes of action, debts, accounts, bonds, contracts, claims and demands for or by reason of any injury to person or property, including injury resulting in the death of you, which has been or may be sustained as a consequence of your participation in the activity described below, and notwithstanding that such damage, loss or injury may have been caused solely or partly by the negligence of Range Arts.

  25. You understand that you would not be permitted to participate in the activity described below unless you have read and agree to this Agreement.

  26. DETAILS OF THE ACTIVITY: You will participate in the following activity: in-classroom instruction with a practical hands-on training component. You may be required to handle firearms under supervision. Any firearm can be dangerous if misused, causing injury or even death.

  27. CONCURRENT RELEASE: You acknowledge that this Agreement is given with the express intention of effecting the extinguishment of certain obligations owed to you and with the intention of binding your spouse, heirs, executors, administrators, legal representative and assigns.

  28. FITNESS TO PARTICIPATE: You acknowledge that you do not have any physical limitations, medical ailments, physical or mental disabilities that would limit or prevent you from participating in the above mentioned activity. If required, you will obtain medical examination and clearance.

  29. FULL AND FINAL SETTLEMENT: You hereby acknowledge and agree that you have carefully read this Agreement, and that you fully understand the same, and that you are freely and voluntarily executing the same.

  30. You understand that by indicating you have read and agree to this Agreement and by completing your booking, you agree to be forever prevented from suing or otherwise claiming against Range Arts for any property loss or personal injury that you may sustain while participating in or preparing for the above noted activity.

  31. You have been given the opportunity and have been encouraged to seek independent legal advice prior to indicating you have read and agree to this Agreement and completing your booking.

  32. ENTIRE AGREEMENT: This Agreement contain the entire understanding between you and Range Arts and supersedes any other content (including content to the contrary on https://rangearts.ca) or any other written or verbal communication between you and Range Arts.

  33. GOVERNING LAW: This agreement will be governed by and construed in accordance with the laws of the Province of Ontario.

You and Range Arts have duly agreed on the date you completed this booking.
